Obtaining informed consent from patients prior to a medical or surgical procedure is a fundamental part of safe and ethical clinical practice. Currently, it is routine for a significant part of the consent process to be delegated to members of the clinical team not performing the procedure (eg, junior doctors). However, it is common for consent-taking delegates to lack sufficient time and clinical knowledge to adequately promote patient autonomy and informed decision-making. Such problems might be addressed in a number of (...) ways. One possible solution to this clinical dilemma is through the use of conversational artificial intelligence using large language models (LLMs). There is considerable interest in the potential benefits of such models in medicine. For delegated procedural consent, LLM could improve patients’ access to the relevant procedural information and therefore enhance informed decision-making.In this paper, we first outline a hypothetical example of delegation of consent to LLMs prior to surgery. We then discuss existing clinical guidelines for consent delegation and some of the ways in which current practice may fail to meet the ethical purposes of informed consent. We outline and discuss the ethical implications of delegating consent to LLMs in medicine concluding that at least in certain clinical situations, the benefits of LLMs potentially far outweigh those of current practices. Recently, Australia became the second jurisdiction worldwide to legalize the use of mitochondrial donation technology. The Mitochondrial Donation Law Reform (Maeve’s Law) Bill 2021 allows individuals with a family history of mitochondrial disease to access assisted reproductive techniques that prevent the inheritance of mitochondrial disease. Using inductive content analysis, we assessed submissions sent to the Senate Committee as part of a programme of scientific inquiry and public consultation that informed drafting of the Bill. These submissions discussed a range of bioethical (...) and legal considerations of central importance to the political debate. Significantly, submissions from those with a first-hand experience of mitochondrial disease, including clinicians and those with a family history of mitochondrial disease, were in strong support of this legislation. Those in support of the Bill commended the two-staged approach and rigorous licencing requirements as part of the Bill’s implementation strategy. Submissions which outlined arguments against the legislation either opposed the use of these techniques in general or opposed aspects of the implementation strategy in Australia. These findings offer a window into the ethical arguments and perspectives that matter most to those Australians who took part in the Senate inquiry into mitochondrial donation. The insights garnered from these submissions may be used to help refine policy and guidelines as the field progresses. (shrink)

In today’s evolving understanding of gender, questions arise about the future of the feminist movement. Using Simone de Beauvoir’s The Second Sex, Hugh Ryan's “Who's Afraid of Social Contagion,” and Ben Kesslen’s “How the Idea of a 'Transgender Contagion' Went Viral—and Caused Untold Harm,” this paper explores the concept of the Other to analyze social contagion and gender-based oppression. It argues that while feminism must adapt, its future lies in embracing the experiences of all classified as the Other. Through de (...) This initial volume of the Collected Works of Edith Stein offers, for the first time in English, the unabridged biography of Edith Stein (Teresa Benedicta of the Cross), depicting her life as a child and young adult. Her text ends abruptly because the Nazi SS arrested, then deported, her to the Auschwitz concentration camp in 1942. Edith Stein is one of the most significant German women of the 20th century. At the age of twenty-five she became the (...) first assistant to Edmund Husserl, the founder of Phenomenology. She was much in demand as a writer and lecturer after her conversion from atheism to Catholicism. Later, as a Discalced Carmelite nun, she maintained her intellectual pursuits until she, like so many others, became a victim of the Nazi persecution that raged across Eastern Europe. By making this landmark work available in English, the Institute of Carmelite Studies provides an eye-witness account of persons and activities on the scene at the time when psychology and philosophy became separate disciplines. In addition to photographs and a map, this volume is enhanced with a preface, the foreword and afterword, notes, and a list of places associated with Edith Stein’s life. It is our aim that these, together with Edith Stein’s text, may help bring into relief the many background details of the rich autobiographical work she has left us. (shrink)

This article explores chemical skin bleaching practices in urban Ghana to demonstrate the ways that particular racialized understandings of meaning are deployed in a contemporary postcolonial African society. I argue that the processes of racialization indexed by skin bleaching in Ghana must be contextualized within global racial formations; specifically, they can only be understood by examining the interlinked local and global ideologies and practices of race. In elaborating this argument, the essay also engages with contemporary African diaspora theorization that tends (...) to foreground diasporic identity and experience at the expense of contemporary continental processes. By bringing a postcolonial African society into a dialogue about race, processes of racialization, and the interlinked transnational construction of black identities, this essay offers one way out of the ambivalent relationship that I believe diaspora theorization has with Africa. This article argues that Judith Butler’s neglect of biopolitics in her reading of Michel Foucault’s work on sexuality leads her to propose a genealogy of gender ontology rather than conduct a genealogy of gender itself. Sex was not an effect of a cultural system for Foucault, but an apparatus of biopower that emerged in the eighteenth century for the administration of life. Butler, however, is interested in uncovering how something we call or identify as gender manifests itself in different times (...) and contexts, rather than asking what relations of power made necessary the emergence of gender as a discourse. After examining the theoretical configurations underpinning Butler’s engagement with Foucault’s Herculine Barbin, I suggest a more biopolitically informed reading of how the material body becomes captured by the discourses of sexuality and sex. Finally, the article sets out preliminary questions with which a more strictly Foucauldian genealogy of gender might be conducted. (shrink)

What are the ethical responsibilities of the historian in an age of mass murder and hyperreality? Can one be postmodern and still write history? For whom should history be written? Edith Wyschogrod animates such questions through the passionate figure of the "heterological historian." Realizing the philosophical impossibility of ever recovering "what really happened," this historian nevertheless acknowledges a moral imperative to speak for those who have been rendered voiceless, to give countenance to those who have become faceless, and hope (...) to the desolate. Within barely a year, two school shootings shook Finland. The school shootings shocked Finnish society, forcing media, academics and experts, police and politicians alike to search for reasons behind the violent incidents. Focusing their analysis on the two main Finnish newspapers, Helsingin Sanomat and Hufvudstadsbladet, authoritative sources of information for Finland’s two language communities, the authors maintain that the Finnish case contributes to research on school shootings by evidencing the intimate linkages between the state, gender and violence. The authors argue (...) that violence is to be understood through different discourses about the Finnish state. In particular, they discern three discourses about the state that produce gendered discourses of violence: the welfare state, the realist state and the neoliberal state. The authors conclude that these discourses produce different notions of rational and irrational violence thereby providing different legitimizations for male-embodied/masculine violence. (shrink)

Empathy and sympathy are feeling-acts which bring the self into direct encounter with other persons. In empathy a self grasps the affective act of another self; in sympathy x n persons apprehend a common object while immersed in similar feeling acts. Since touch is the paradigmatic sense for bringing what is felt into proximity with feeling, structural affinities between touch and these feeling acts can be shown. This relationship has been obscured by classical theories of touch in which it is (...) interpreted on analogy with the other senses. When the subject of touch is seen as the living body as a whole, the full range of its possible relationships to affective states can be explored. In this connection the theories of touch of Aristotle, Berkeley and Condillac are critically evaluated. While none recognizes the uniqueness of touch, each sees difficulties in incorporating touch in a general theory of sense. We investigate the effect on the complexity of adding the universal modality and the reflexive transitive closure modality to modal logics. From the examples in the literature, one might conjecture that adding the reflexive transitive closure modality is at least as hard as adding the universal modality, and that adding either of these modalities to a multi-modal logic where the modalities do not interact can only increase the complexity to EXPTIME-complete. We show that the first conjecture holds under reasonable assumptions (...) and that, except for a number of special cases which we fully characterize, the hardness part of the second conjecture is true. However, the upper bound part of the second conjecture fails miserably: we show that there exists a uni-modal, decidable, finitely axiomatizable, and canonical logic for which adding the universal modality causes undecidability and for which adding the reflexive transitive closure modality causes high undecidability. In our society, which is based on the division of labor, the ability to communicate with experts is a core competence. Reflection plays a central role for non-experts/laypersons in classifying and evaluating expert statements, and in the closely related decision-making process. Reflection is seen as a cognitive ability as well as an attitude. Mathematical concepts and models are applied in many socially relevant areas. For a (better) understanding of these, their fit, effects, limitations as well as their role and meaning, (...) they should be dealt with and reflected on different levels. In the paper, the following levels of reflection are considered in more detail from this social perspective: mathematics-oriented, model-oriented, context-oriented, and subject-oriented reflection. The fact that such reflections can also be integrated into mathematics lessons is demonstrated by means of concrete tasks. (shrink)

There is an increasing recognition internationally of the critical impact of communication within healthcare. The link between ineffective communication, patient dissatisfaction and critical incidents is well established. Family Planning New South Wales has sought to address patient-centred care and communication in its policy platform. This article reports on research conducted within FPNSW, which analysed the discourse features that constituted effective doctor–patient1 communication in sexual and reproductive health consultations. The principal aim of the research was to understand how effectively messages were (...) conveyed and received and to what degree patients were active participants in their own sexual healthcare. Analysed consultations were characterised by extremely high levels of communicative competence on the part of the doctors who integrated medical expertise with the development of interpersonal relationships with patients, thus positioning patients as active contributors to the consultations and to decisions about their ongoing treatment. The detailed linguistic analysis identified characteristic features of patient-centred communication that are essential to patient-centred care. These interactions demonstrate that communicating care is just as important as delivering care and involves a drawing together of the medical and the interpersonal in consultations. The article details strategies for interweaving medical knowledge and establishing rapport that can inform practitioner communication practices across different healthcare contexts. (shrink)
